Terms & Conditions

Le Pirate Explorer

We’re so happy you’re considering an Overnight Sharing Cruise with Le Pirate Explorer. We’ve created this short and easy-to-read guide so you know what to expect. By booking with Le Pirate Explorer, you agree to the terms below, which are designed to keep everything safe, clear, and enjoyable for everyone.

1. General Information

By accessing or booking through lepirate.com, you agree to the terms outlined below. These terms apply to all direct and/or third-party reservations for Le Pirate Explorer and related experiences.
‎

2. Booking

  • Your booking is confirmed once Le Pirate Explorer receives payment or a deposit.
  • Some bookings may require full payment upfront.
  • Le Pirate Explorer accepts payment via Bank Transfer, Visa and MasterCard.
  • Prices are including government taxes where stated.
  • Rates may vary based on dates, length of stay, or special promotions.
  • Fuel surcharge: diesel prices in Indonesia are currently volatile. If the delivered fuel cost rises by more than 3% above our 30 September 2026 baseline, Le Pirate Explorer may apply a fuel surcharge to your cruise. This applies to all bookings, including those made before this notice. We will notify you in writing before your final payment is due, with the surcharge amount and how it was calculated. Applies equally across Komodo, Beyond Komodo, and Raja Ampat routes.
  • For harbor clearance, guests are required to provide valid personal information but not limited to ID number at the time of booking. Failure to provide this information may result in boarding restrictions.
  • Certain shared departures may be subject to minimum occupancy requirements. Please refer to Section 10 for further details.

3. Age Policy

  • Guests must be at least 16 years or older to join Le Pirate Explorer Overnight Sharing Cruise

  • 25% Deposit – Upon Booking
22 Days or more before departure : Non refundable
21 Days or less before departure : Non refundable
  • 75% Final Payment – 21 Days before departure

21 Days or less before departure : Non refundable

5. Departure & Return

  • Departure Time : Cruise departs promptly at 10:00 AM. Guests must present a valid government-issued ID prior to boarding.
  • Return Time : Cruises generally return at approximately 3:00 PM on the finalday. Return times are estimates and may vary depending on weather, sea conditions, operational requirements, or harbour authority instructions.
  • Meeting points, departure locations, and return locations may vary depending on the selected itinerary and will be confirmed in your booking confirmation.
  • Guests are strongly advised to arrive in the designated departure city at least one day before departure to minimise the risk of missing the cruise due to travel delays.
  • Unless otherwise stated, guests are responsible for arranging and paying for their own transportation to the designated meeting points and/or departure locations.

6. No Show & Late Arrival Policy

  • No Show.
Guests who fail to arrive at the agreed meeting point and time without prior notice will be considered a “no show”. In this case, the booking will be cancelled, and no refund will be issued.
  • Late Arrival.
If you are delayed due to flight issues or other transport disruptions, please contact us as soon as possible. While the Le Pirate Explorer will depart as scheduled, Le Pirate Explorer will do our best to assist by arranging a private speedboat transfer to the cruise’s current location. All costs associated with catching up to the boat (e.g., private speedboat fees) are the responsibility of the guest. No compensation will be provided for missed departure.

7. Delay & Cancelation Due To Mechanical Failure

  • Delays due to Mechanical Failure.
In the event that a departure is delayed due to mechanical failure or technical issues with the vessel, Le Pirate Explorer will make every reasonable effort to rectify the issue promptly. If the departure is delayed by more than 4 hours, compensation will be issued on a pro-rata basis, limited to the proportional value of the hours or days lost relative to the total duration and cost of the scheduled trip.
  • Trip Cancellation and Alternative Transport.
If a mechanical failure prevents the vessel from departing entirely or continuing the itinerary, and the trip must be canceled by the operator, Le Pirate Explorer will first attempt to arrange an alternative vessel of a comparable standard to complete the scheduled journey.
  • Refund Extent for Operator Cancellation.
If a comparable alternative vessel cannot be sourced, Le Pirate Explorer will cancel the trip and process a refund. Because the cancellation is due to operator mechanical failure, the 25% non-refundable deposit restriction is waived, and refunds will be processed to the following extent:
    • Cancellation Prior to Departure: A 100% full refund of all monies paid to Le Pirate Explorer including the 25% deposit.
    • Cancellation During the Trip (Mid-Journey): A pro-rata refund calculated strictly on the unused portion of the itinerary, inclusive of a proportional return of the deposit value.
  • Exclusion of Consequential Damages.
In no event shall Le Pirate Explorer be held liable for any indirect, consequential, or incidental damages, including but not limited to flights, hotel bookings, land transfers, missed connections, or external travel arrangements booked independently by the passenger. Passengers are strongly encouraged to purchase comprehensive travel insurance to cover such external losses.

8. Force Majeure

  • Le Pirate Explorer is not liable for failure to perform due to events beyond our control, including but not limited to natural disasters, government regulations, transportdisruptions, or other acts of God and force majeure — such as earthquakes, tsunamis, volcanic eruptions, extreme weather conditions, or pandemics.
  • No refunds will be given due to these external issues.
  • Due to the remote and maritime nature of Le Pirate Explorer’s operations, travel disruptions may occur as a result of weather conditions, sea state, or official authority restrictions. Guests are strongly encouraged to obtain comprehensive travel insurance covering trip changes, delays, missed connections, medical emergencies, and evacuation costs. In the absence of appropriate insurance, guests remain responsible for any additional expenses arising from circumstances beyond Le Pirate Explorer’s control.

9. Itinerary & Activities

  • Le Pirate Explorer reserves the right to modify or cancel the itinerary due to weather conditions, sea state, or operational considerations (Harbour Master’s instruction, technical issue, etc).
  • No refund or compensation will be given for itinerary changes caused by external or natural factors.

10. Minimum Occupancy Requirement for Selected Shared Departures
Shared departures on selected itineraries, including Beyond Komodo 3 and Raja Ampat 2, require a minimum of two (2) booked cabins in order to operate.
Reservations are accepted on request and are confirmed upon receipt of the applicable deposit in accordance with our Payment Terms.
If the minimum occupancy has not been reached by forty-five (45) days prior to departure, Le Pirate Explorer reserves the right to cancel the shared departure without penalty or liability. In such event, guests may choose to:

  • transfer their reservation to another departure date, subject to availability;
  • transfer to an alternative itinerary, subject to availability;
  • receive a full refund of all monies paid; or
  • upgrade to a private charter at the applicable charter rate.
    ‎

Le Pirate Explorer shall not be liable for any costs incurred outside the booking with us, including but not limited to flights, accommodation, transfers, visas, travel arrangements, or other third-party services. Guests are strongly encouraged to obtain appropriate travel insurance to cover such circumstances.

  • Le Pirate Explorer operates in remote island and maritime environments. Basic first aid assistance is available onboard; however, access to medical facilities may require transfer to the mainland. Any medical treatment, evacuation, transportation, accommodation, or related expenses are not included and remain the responsibility of the guest.
  • Participation in any onboard or offboard activity, including but not limited to swimming, snorkeling, diving, trekking, paddleboarding, kayaking, or other water activities, is entirely at the guest’s own risk. Guests must follow all safety instructions provided by the crew at all times.
  • Guests must inform Le Pirate Explorer before departure of any medical conditions, allergies, dietary requirements, pregnancy, medication, or mobility limitations that may affect their participation in the cruise or any activities.
  • Le Pirate Explorer reserves the right to refuse boarding or discontinue participation in the cruise, without refund, if a guest’s medical condition, physical fitness, behaviour, or failure to follow safety instructions is considered to pose a risk to themselves, other guests, the crew, or the safe operation of the vessel.
